Rule 29. Election to Remain in Placement as a Young Adult
(a) Eligibility. Any child who is in foster care on the child's eighteenth (18th) birthday and who meets the requirements of G.L. 1956 § 14-1-6(c) or (d), may voluntarily elect to extend care and placement by the Department of Children, Youth, and Families and to remain under the legal supervision of the court as a young adult until age twentyone (21).
(b) Petition. If an eligible child elects to extend placement until the age of twentyone (21), a representative of the Department of Children, Youth, and Families shall file a petition for legal supervision of a young adult in accordance with the procedure and requirements set forth in G.L. 1956 § 14-1-11.1.
(c) Hearings and Reviews. The court shall conduct a review of the progress of and the case plan for the young adult within one hundred eighty (180) days from the date the voluntary placement agreement was signed; and, the court shall hold a permanency hearing within one (1) year from the date the voluntary placement agreement was signed and annually thereafter, until the age of twenty-one (21).
