Rule 65. Electronic filing

(a) The electronic filing of documents in the Court of Common Pleas shall be referred to as "eFile" or "eFiling".

(b) The Chief Judge of the Court of Common Pleas shall establish administrative procedures for the eFiling of documents.

(c) When the Chief Judge of the Court of Common Pleas determines that it is appropriate for any criminal case, category of cases, document, or category of documents, to be electronically filed, the Chief Judge of the Court of Common Pleas shall designate such as an eFile case or document.

(d) No Delaware lawyer shall authorize anyone to eFile on that lawyer's behalf, other than an employee of his/her law firm or service provider retained to assist in eFiling.

(e) All eFilings must be signed, by written or electronic signature, by a Delaware attorney or by the filing party if not represented by counsel.

(f) The email address of the filing party must be provided in all eFiled documents.

(g) Unless otherwise ordered, the electronic service of a document, in accordance with the eFile administrative procedures, shall be considered service under Court of Common Pleas Criminal Rule 49. History. Added Aug. 25, 2020, effective Aug. 27, 2020.
