Rule 38-15. Application of Bail Commissioner

A bail commissioner who has reason to believe that a person released under any of the provisions of these rules or of the General Statutes intends not to appear in court as required by the conditions of release may apply to a judicial authority for the court before whom such person is required to appear, and verify by oath the reason for this belief, and request that such person be brought before the judicial authority in order that the conditions of release be reviewed. Upon finding reasonable grounds to believe that the released person intends not to appear, such judicial authority shall forthwith issue a capias directed to a proper officer or indifferent person, commanding him or her forthwith to arrest and bring such person to the court for a hearing to review the conditions of his or her release. Copies of the bail commissioner's application shall be served upon the defendant, the prosecuting authority and any sureties upon any bond.
